Notice of Public Meeting

 for a proposed Official Plan Amendment and

a proposed Zoning By-Law Amendment

affecting the Municipality of South Huron

Take notice that the Council of the Corporation of the Municipality of South Huron will hold an electronic public meeting on Monday, May 10th, 2021 at 6:00pm in the Municipality of South Huron Council Chambers, 322 Main Street South, Exeter, to consider a proposed Official Plan Amendment under Section 17 & 22 of the Planning Act and a proposed Zoning By-law amendment under Section 34 of the Planning Act.

You are being notified of this application because your name appears on the assessment roll for properties within 120 metres of the subject lands or you are an agency requiring notice. If you are an owner of any land containing seven or more residential units you are requested to post this notice in a location that is visible to all of the residents.

Be advised that the Corporation of the Municipality of South Huron considered this application to be complete on March 24, 2021.

Any person may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the proposed official plan amendment and zoning change.

If a person or public body does not make an oral submission at a public meeting or make a written submission to the Municipality of South Huron before the zoning by-law amendment is passed or the official plan amendment is adopted, the person or public body is not entitled to appeal the decision of the Municipality of South Huron on the zoning by-law amendment or the decision of the County of Huron on the official plan amendment to the Local Planning Appeal Tribunal.

If a person or public body does not make an oral submission at a public meeting or make a written submission to the Municipality of South Huron before the zoning by-law amendment is passed or the official plan amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

If you wish to be notified of the decision on the proposed zoning by-law amendment and/or official plan amendment, you must make a written request to the Municipality of South Huron, 322 Main Street South, Exeter, ON, N0M 1S6.

Additional Information relating to the proposed amendments may be obtained at the South Huron Municipal Office, or by contacting Vanessa Culbert, Planning Assistant, at 519-235-0310, between the hours of 8:30 a.m. and 4:30 p.m. (Monday to Friday). Information may also be posted on the South Huron website (www.southhuron.ca).

Purpose & Effect:

Official Plan Amendment No. 21 to the South Huron Official Plan and its associated Zoning By-law Amendment Application Z03-2021 to the South Huron Zoning By-law 69-2018 affect the lands legally described as the East Part of Lot 25, Concession 7, Usborne Ward, Municipality of South Huron. The subject lands are municipally known as 41351 MacDonald Road.

Now that the sand resource has been depleted on this property, the property owner rehabilitated the pit to an agricultural use as required by the aggregate license and has subsequently surrendered the license. The application proposes to update the designation of the property to reflect its current status and plans for use agriculturally and as a woodlot going forward.

The subject lands are currently designated Mineral Aggregate in the South Huron Official Plan. The approximately 3 hectare woodlot in the southeast corner of the property is proposed to be designated “Natural Environment” to match its existing use while the balance of the lands which have been rehabilitated to agriculture would have an Agriculture designation.

The concurrent Zoning By-law Amendment proposes a zone change from the existing ER1 (Extractive Resources) zone to AG1 (General Agriculture) and NE2 (Natural Environment) zones to match the proposed designation changes on the property.

The Zoning By-law Amendment will not come into force until the Official Plan Amendment (OPA 20) is approved by the County of Huron, in accordance with Section 43(21) of the Planning Act.

Written submissions should be sent to the attention of the Planning Assistant, and received no later than noon on May 10, 2021.

For those persons who wish to participate orally at the hearing, there is an option to join the electronic hearing; please contact the Planning Assistant  for a specific meeting invitation: at planning@southhuron.ca (519-235-0310). Those who wish to participate orally are to contact the Planning Assistant no later than 4 p.m. on May 10, 2021.

Please note that comments and opinions submitted on these matters, including the originator’s name and address, become part of the public record and may be viewed by the general public and maybe published in a Planning Report, Council Agenda or Council Minutes.

If any member of the public would like to be notified in writing of the decision on the application they are to provide their name and mailing address to the Planning Assistant via email, mail or telephone.
