Notice of Application by Owner to Repeal Designation By-Law Under Section 32 of the Ontario Heritage Act, R.S.O. 1990, c.O.18

The Ontario Heritage Act, R.S.O.1990, c. O.18 as amended, provides that an owner of property designated under the Ontario Heritage Act may apply to Municipal Council to repeal the by-law or part thereof designating the property.

Take Notice that the Council of the Municipality of South Huron has received an owner’s application to repeal By-Law #23-1993, which designates 12 Victoria Avenue East, Crediton, legally described as Plan 211, Part Lot 5; Stephen Ward, Municipality of South Huron, under section 29 of the Ontario Heritage Act. 

Statement of Cultural Heritage Value or Interest:

The Henry Eilber house, also known as the Village Post Bed and Breakfast, was built in 1888 by Henry Eilber, one of the founders of Hay Township Municipal Fire Insurance, Clerk for Stephen Township until 1896 before becoming an MPP. His son, Herbert Eilber, was given the position of Clerk at the age of 16 and worked out of the building. Heritage attributes include stained glass windows imported from Germany, bricks from the Crediton brick yards, an original tin ceiling, original floors and chimney, and original outside sills made of cut stone.

The repeal of the designation by-law is to be considered by South Huron Council at its December 15, 2025 Regular Council (6pm).

Any person may, within 30 days after the publication of this Notice, serve on the Municipal Clerk, a Notice of Objection in writing, setting out the reasons for the objection and all relevant facts. A Notice of Objection is then considered by Council in its deliberation on the matter. A decision of Council may be appealed by submitting a Notice of Appeal with the Ontario Land Tribunal (OLT) and the Municipal Clerk. Any objection to this application to repeal By-Law #23-1993 must be filed with the Municipal Clerk no later than November 28, 2025.
